What is copyright?

The Board of Canada states it’s mandate is limited to establishing, either mandatorily or at the request of an interested party, the royalties to be paid for the use of copyrighted works, when the administration of such copyright is entrusted to a collective administration society. The Board also has the right to examine, further to a request by the Commissioner of Competition, agreements between users and licensing bodies and issues when the copyright owner cannot be located.

The Board is not responsible for the enforcement of their tariffs.

The Copyright Act establishes that when music is copied or performed in public, or communicated to the public by telecommunication, the following groups of rights owners are entitled to be paid for the use of their works:

-the authors and the composers of the musical works; and

-the performers and the makers of the sound recordings embodying musical works.

For example, royalties for performance of recorded music in public are currently set in two tariffs certified by the Copyright Board: a Re:Sound tariff and a SOCAN tariff. The performers and makers of sound recordings are often not the same people as the authors and composers of the musical work. When the Copyright Act was amended in 1997, it provided a right of remuneration to performers and makers of sound recordings in addition to authors’ and composers’ rights. As a result, in general, when a person (an individual or an organization) plays recorded music in public, it must pay royalties to both SOCAN, on account of authors and composers, and to Re:Sound, on account of sound recording makers and performers.

The Re:Sound Music Licensing Company (formerly known as NRCC) represents music performers and makers of sound recordings.

SOCAN represents authors, composers and publishers of musical works and has been in existence and collecting royalties before the creation of Re:Sound.

Contact Re:Sound or SOCAN or head straight to Entandem to get some clarification on which tariffs apply to your type of establishment and/or activities. It maybe a party, band, function, website, parade etc. . . . 

For example, if you were a float participating in a parade and you use music from a popular movie, you are required to pay copyright fees. First you need to register on the Entandem website.

Minimum fee is approx $40CA (Sep 2019). So one float pays it’s fee (plus Provincial Tax) which is split almost 50/50 between SOCAN and Re:Sound.

Should you be hosting a parade, Subject to the minimum fee, each float should be charged approx $11CA.
